Please read these Terms of Service (“Terms”) carefully before using the services offered by Atlas PCB (“we”, “us”, or “our”) through our website https://www.atlaspcb.com (the “Service”).

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You represent that you are at least 18 years old or the age of legal majority in your jurisdiction.

2. Description of Service

Atlas PCB provides custom printed circuit board (PCB) manufacturing and assembly (PCBA) services. Our services include:

  • PCB fabrication (rigid, flex, rigid-flex, HDI, high-frequency, heavy copper, aluminum)
  • PCB assembly (PCBA) with component sourcing
  • Engineering design review (DFM/DFE analysis)
  • Global shipping via major carriers

All PCBs are custom-manufactured to your specifications. This is important for understanding our refund policy — see our Refund & Return Policy.

3. Account Registration

To place orders, you must create an account with accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities under your account
  • Promptly notifying us of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Order Process

4.1 Quoting

Upload your Gerber files and specifications to receive an instant or manual quote. Quotes are valid for 7 days unless otherwise stated.

4.2 Engineering Review

Our engineering team performs a pre-production review of your design files. This review is a courtesy advisory service to identify potential manufacturability issues. It does not constitute a guarantee of design correctness or fitness for your intended purpose. Final design responsibility rests with you, the customer.

4.3 Manufacturing

Upon order confirmation and payment, we begin manufacturing. Lead times are estimates and may vary based on complexity, material availability, and production capacity.

4.4 Payment

Full payment is required before manufacturing begins. We accept payment via Stripe (credit card, debit card, and other methods supported by Stripe). All prices are displayed in USD unless otherwise specified. Applicable taxes and duties are the buyer’s responsibility.

4.5 Shipping

We ship worldwide via DHL, FedEx, UPS, EMS, and SF Express. See our Shipping Policy for details on methods, timelines, and costs.

5. Intellectual Property & Confidentiality

5.1 Your Designs

You retain full intellectual property rights to all design files, Gerber files, BOMs, and other materials you upload. We claim no ownership of your designs.

5.2 Confidentiality

We treat all customer design files as strictly confidential. We will:

  • Use your design files only for manufacturing your order
  • Not share your designs with any unauthorized third party
  • Not reverse-engineer, copy, or use your designs for any other purpose
  • Store files securely with access controls
  • Delete files upon your request (subject to legal retention requirements)

Our manufacturing partners are bound by confidentiality obligations.

5.3 Our Content

All website content, logos, text, graphics, and software are owned by Atlas PCB and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

6. Quality Standards

We manufacture PCBs in compliance with:

  • IPC-A-600 (Acceptability of Printed Boards)
  • IPC-6012 (Qualification and Performance Specification for Rigid PCBs)
  • IPC Class 2 (standard) or IPC Class 3 (high-reliability, upon request)

Our partner factories hold ISO 9001 and, where applicable, IATF 16949 certifications. Specific quality requirements should be stated at the time of ordering.

7. Refund & Returns

Due to the custom nature of PCB manufacturing, our refund policy is specific to this industry. Please review our full Refund & Return Policy.

In summary:

  • Quality defects (our fault): Full refund or free remake
  • Doesn’t match your Gerber files (our fault): Full refund or free remake
  • Shipping damage: Full refund or free remake (with evidence)
  • Customer design errors: Not eligible for refund (discounted remake available)
  • Change of mind: Not eligible for refund (custom products)

8. Export Compliance

PCBs and related technologies may be subject to export control laws and regulations, including but not limited to:

  • U.S. Export Administration Regulations (EAR)
  • EU Dual-Use Regulation (EC) No 2021/821
  • Hong Kong Strategic Commodities Control
  • Wassenaar Arrangement

You represent and warrant that:

  • You will comply with all applicable export laws and regulations
  • You will not use our products in connection with weapons of mass destruction (nuclear, chemical, biological, or missile technology)
  • You are not located in, and will not export our products to, any country subject to comprehensive sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions)
  • You are not listed on any government restricted party list

We reserve the right to refuse any order that we believe may violate export control laws. See our Export Compliance page for details.

We do not accept ITAR-controlled designs. If your design is subject to ITAR (International Traffic in Arms Regulations), please seek a US-based manufacturer.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific order giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or cost of substitute products.
  • We are not liable for delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, pandemics, government actions, supply chain disruptions, or carrier delays.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

10. Warranty Disclaimer

THE SERVICE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • Our products will meet your specific design requirements beyond the provided Gerber specifications
  • The Service will be uninterrupted, error-free, or secure
  • Any defects will be corrected

This disclaimer does not affect your statutory rights as a consumer under applicable law, including EU consumer protection laws.

11. Indemnification

You agree to indemnify and hold Atlas PCB harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your design files infringing third-party intellectual property rights
  • Your misuse of our products

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

12.2 Dispute Resolution

Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its applicable rules.

12.3 EU Consumer Rights

If you are an EU consumer, nothing in these Terms affects your mandatory consumer rights under the laws of your country of residence. You may also bring proceedings in the courts of your member state.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • Pending orders in production will be completed and shipped
  • You may request deletion of your account and personal data (subject to legal retention requirements)

14. Modifications

We may modify these Terms at any time. Material changes will be communicated via website notice or email. Continued use of the Service after changes constitutes acceptance. If you disagree with changes, please stop using the Service.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to be enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, Cookie Policy, and Export Compliance, constitute the entire agreement between you and Atlas PCB.
